1. Purpose

These terms of use ("Terms of Use") govern access to and use of the Kotidy service, available through the website kotidy.app and the Kotidy mobile application (the "Service"), published by Baptiste Levesque, sole trader (see the Legal Notice).

Kotidy is an application for organising a household's everyday life: shared shopping lists, projects and tasks, recurring chores and a shared calendar, synchronised in real time between the members of the same household.

Use of the Service implies full and unreserved acceptance of these Terms of Use, evidenced by a checkbox ticked when the account is created. Subscribing to a paid plan is further governed by the Terms of Sale.

2. Definitions

  • User: any natural person holding an account on the Service.
  • Household: a sharing space created on the Service, bringing together one or more Users (family, couple, flatshare, etc.).
  • Member: a User attached to a Household. A Member has the role of "admin" or "member".
  • Content: any data entered by a User into the Service (shopping items, tasks, events, comments, names, etc.).

3. User account

3.1. Creating an account requires a valid email address and a password, or the use of a sign-in link sent by email. The User undertakes to provide accurate information and to keep it up to date.

3.2. The Service is reserved for persons aged 15 or over. Minors aged 15 to 18 declare that they use the Service with the consent of their legal guardians.

3.3. The User is responsible for keeping their login credentials confidential and for any activity carried out from their account. In the event of unauthorised use, the User undertakes to inform the publisher without delay at contact@kotidy.app.

3.4. An account is strictly personal and may not be transferred or shared.

4. Households and data sharing

4.1. The Service is built on sharing: all Content added to a Household (lists, tasks, events, activity, etc.) is visible to and editable by all Members of that Household, with the exception of calendar events marked as "personal", which are visible only to their creator.

4.2. A new Member is invited by means of a time-limited invitation link or code. By joining a Household, the User gains access to the history of that Household's Content.

4.3. "Admin" Members may invite and remove Members and manage the Household. A Household must always have at least one admin.

4.4. Leaving a Household results in the loss of access to its Content. Deletion of a Household by its last admin is permanent and deletes all of its Content for all Members, after explicit confirmation.

4.5. Each User remains responsible for the Content they publish in a Household and for its lawfulness.

5. Rules of use

The User shall in particular refrain from:

  • using the Service for unlawful or fraudulent purposes or in a manner that infringes the rights of third parties;
  • publishing Content that is unlawful, defamatory, abusive, or that infringes the privacy of others;
  • attempting to access the data of other Households, circumventing security measures, or disrupting the operation of the Service (deliberate overloading, injection, reverse engineering outside the cases permitted by law);
  • reselling or commercially exploiting the Service without authorisation;
  • creating accounts by automated means.

6. User Content

6.1. The User retains full ownership of their Content.

6.2. The User grants the publisher a non-exclusive, worldwide, royalty-free licence to host, reproduce and display their Content, strictly limited to what is necessary to provide the Service (storage, real-time synchronisation between Members, backups, notifications). This licence ends upon deletion of the Content or of the account, subject to time-limited technical backups.

6.3. The publisher does not use the Content for advertising purposes and does not sell it to any third party.

7. Free plan and Premium plan

7.1. The Service comprises a free plan, in which certain features or volumes are limited, and a paid "Premium" plan giving access in particular to recipes and meal planning, fairness statistics, global search, iCal export of the calendar, chores with multiple occurrences, as well as extended limits (lists, projects, tasks and tags). The up-to-date details of the features of each plan and of the limits of the free plan are set out on the Pricing page.

7.2. The conditions of subscription, price, withdrawal and cancellation of the Premium plan are set out in the Terms of Sale.

7.3. The publisher may change the scope of the plans. Any substantial reduction in the features of the Premium plan during a subscription gives rise to a right of cancellation under the conditions set out in the Terms of Sale.

8. Account suspension and deletion

8.1. In the event of a serious or repeated breach of these Terms of Use, the publisher may suspend the User's account after notification by email stating the reasons and, except in urgent cases or where required by law, a reasonable period in which to remedy the breach. The account may only be deleted in the event of a persistent or particularly serious breach.

8.2. The User may delete their account at any time, from the Settings of the Service or by sending a request to contact@kotidy.app (see also the Privacy Policy). Deletion is permanent; if the User is the last Member of a Household, that Household and its Content are deleted together with the account. The treatment of any current subscriptions is governed by the Terms of Sale.

9. Availability and evolution of the Service

9.1. The publisher endeavours to ensure continuous access to the Service, without guaranteeing absolute availability. Interruptions may occur for maintenance, updates or security reasons; significant planned interruptions are announced wherever possible.

9.2. The Service evolves continuously (features are added and modified). An offline mode is offered in the mobile application; data entered offline is synchronised when the network returns, the most recent version of a piece of data prevailing in the event of concurrent modification.

9.3. The User is invited to keep their application up to date; obsolete versions may stop working.

10. Publisher's intellectual property

The Service, its structure, design, logos and code remain the exclusive property of the publisher. These Terms of Use do not entail any assignment of intellectual property rights to the User, who benefits only from a personal, non-exclusive right to use the Service.

11. Liability

11.1. The publisher is bound by a best-efforts obligation (obligation de moyens) in providing the Service. The publisher cannot be held liable for damage resulting from use of the Service that does not comply with these Terms of Use, from Content published by Users, or from events beyond its reasonable control.

11.2. The User is solely responsible for their Content and for the use they make of the Service (in particular for the accuracy of household organisation information: the Service is an organisational aid, not a safety or alert device).

11.3. Nothing in these Terms of Use excludes or limits the publisher's liability in the event of gross negligence or wilful misconduct, personal injury, or in any other case where the law prohibits such a limitation. The consumer's statutory rights are not affected.

12. Personal data

The processing of personal data is described in the Privacy Policy, which forms an integral part of the contractual framework.

13. Changes to the Terms of Use

The publisher may amend these Terms of Use. Users are informed of any substantial change by email or by notification within the Service at least 15 days before it takes effect. Continued use after that date constitutes acceptance; otherwise, the User may delete their account (and, where applicable, cancel their subscription under the conditions set out in the Terms of Sale).

14. Governing law, disputes

These Terms of Use are governed by French law. In the event of a dispute, an amicable solution will be sought first; the consumer may use, free of charge, the consumer mediator designated in the Legal Notice. Failing that, the French courts have jurisdiction under the ordinary rules of law.
